Se trata de un documento marco que pretende ser una herramienta de ayuda para que las empresas o centros de trabajo sepan qué tipo de acciones tienen que llevar a cabo para que su buen funcionamiento no se vea dificultado por la pandemia de gripe A/H1N1.&lt;br /&gt;Entre los objetivos de la guía figura que las empresas y centros de trabajo se familiaricen con las actuaciones de las autoridades sanitarias en relación a la pandemia para facilitar una colaboración mutua. Asimismo, se busca favorecer el intercambio de información útil que contribuya a hacer frente al posible impacto de la pandemia de gripe en las empresas o centros de trabajo mediante la elaboración de sus propios planes de actuación. &lt;br /&gt;Estos planes de actuación para las empresas son de especial importancia en los sectores considerados esenciales; es decir, en todos aquellos que deben garantizar el mantenimiento y la operatividad de las infraestructuras críticas para el funcionamiento del país (energético, sanitario, etc.).&lt;br /&gt;En cualquier caso, la guía no pretende establecer nuevas obligaciones ni trasladar responsabilidades de las administraciones sanitarias de Salud Pública a las empresas o centros de trabajo. De hecho, en todo lo relacionado con cuestiones laborales o materia laboral, que afecten directa o indirectamente a los derechos de los trabajadores (condiciones de trabajo, derechos de participación, información y consulta, etc.) se estará a lo regulado en el Estatuto de los Trabajadores y en el resto de las normas laborales de aplicación.&lt;br /&gt;APLICACIÓN DE LA GUÍA &lt;br /&gt;La guía es un documento diseñado para aplicarse en fases avanzadas de la pandemia de gripe o, lo que es lo mismo, cuando la productividad de una empresa pueda estar amenazada por brotes de gripe. &lt;br /&gt;Para ayudar a las empresas o centros de trabajo en su preparación, se ha elaborado una lista que identifica las medidas específicas que deben valorar e ir desarrollando para prepararse frente a los efectos de una pandemia de gripe. Muchas de estas medidas también serán útiles durante otro tipo de emergencias, ya que son de carácter general y deben adaptarse a esta situación en particular y a las características específicas de cada tipo de empresa o centro de trabajo.&lt;br /&gt;Las medidas son de distintos tipos y se dividen en:&lt;br /&gt;• Preparación para el impacto de una pandemia en su empresa (incluye actividades como designar un coordinador y un equipo que trabaje en la planificación de las labores de respuesta a la pandemia, determinar áreas y empleados esenciales, etc.). &lt;br /&gt;• Preparación para el impacto de una pandemia en sus empleados y clientes (prepararse para la ausencia de empleados por enfermedad personal o familiar o por cuarentenas, establecer reglas para modificar la frecuencia y el tipo de contacto de persona a persona, etc.). &lt;br /&gt;• Establecimiento de medidas de contingencia para la pandemia (valorar la posibilidad de que los empleados puedan trabajar desde casa o con un horario flexible, etc.). &lt;br /&gt;• Asignación de fondos para proteger a su personal y a sus clientes (poner a disposición de los trabajadores material para controlar la infección como productos de higiene de manos, etc.). &lt;br /&gt;• Formación e información de los trabajadores y comunicación con ellos (prever situaciones de temor y ansiedad en los empleados, rumores; ofrecer información sobre las páginas web, teléfonos de consulta, etc.). &lt;br /&gt;• Coordinación de esfuerzos con otras organizaciones (colaborar con las autoridades sanitarias, compartir las buenas prácticas de su empresa, etc.). &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;PROTECCIÓN DE LOS TRABAJADORES &lt;br /&gt;La guía para empresas también incluye un apartado específico con indicaciones para proteger la salud de los trabajadores. La Audiencia anula la doble escala salarial de los convenios 2006-2008 de Repsol Química, Petróleo y Butano, unificando criterio para todo el grupo. Esta sentencia sucede a las del Tribunal Supremo, que también anularon esa doble escala salarial de los convenios anteriores en Repsol Petróleo y Butano. &lt;br /&gt;&lt;br /&gt;Empresa y sindicatos firmantes llevan años vulnerando el derecho de igualdad de los trabajadores contratados después del 31 de diciembre de 1994, negando su derecho a recibir el mismo complemento de antigüedad que el resto, estableciendo con ello una doble escala salarial que se ceba especialmente con los jóvenes. &lt;br /&gt;&lt;br /&gt;José Vía, Secretario de Acción Sindical de USO, se felicita por el fallo de la Audiencia, porque “reconoce los derechos de más de 6.000 trabajadores y homogeneiza el criterio en las distintas empresas del mismo grupo, que estaban aplicando la misma desigualdad como medida de abaratamiento de costes de personal”. “Esperamos enterrar así la discriminación firmada por CCOO, UGT, CC y CTI, que, tras dos sentencias del Tribunal Supremo han seguido firmando idénticas cláusulas de doble escala salarial para los años siguientes”, añadió. &lt;br /&gt;&lt;br /&gt;Falla la Audiencia “que estimando la demanda de conflicto colectivo, interpuesta por USO, venimos a anular el artículo 14 (…) y en consecuencia ordenamos a dicha mercantil a estar y pasar por dicha declaración así como a que se abone el complemento de antigüedad de acuerdo a la propia normativa pactada a los trabajadores contratados con posterioridad a 31-12-1994, condenándose, asimismo, a CCOO a UGT y ACTI a estar y pasar por dicha declaración a todos los efectos legales oportunos”. &lt;br /&gt;&lt;br /&gt;Ha declarado Vía al respecto que “la hipocresía sindical hace que dejen tirados a los trabajadores cada vez que se firma un documento y acaban de hacerlo otra vez para el convenio de 2009-2010, firmado en los primeros días de julio. El resultado de la misma es la desestimación de la demanda por parte del os trabajadores y la declaración de procedencia del despido.&lt;br /&gt;Ante esta nueva situación y tras el análisis de la demanda por los servicios jurídicos de este sindicato, estamos ya trabajando para la interposición de recurso ante una sentencia que respetamos pero que no es entendible y mucho menos compartida. Es claro que este proceso no termina aquí y los trabajadores y este sindicato somos conscientes de ello por lo que seguimos confiando plenamente en la justicia, en la convicción de un resultado final satisfactorio para los trabajadores. En las primeras semanas de marzo, el recurso estará presentado en los juzgados y quedaremos a la espera de la resolución por parte del T.S.J. de Canarias.&lt;br /&gt;El camino recorrido hasta aquí no ha sido nada fácil y este primer resultado no debe, ni mucho menos, desanimarnos, por ello debemos trasmitir tranquilidad y confianza a todos los trabajadores y esperar el resultado del proceso judicial.&lt;br /&gt;La USO, continúa trabajando desde la seriedad y la responsabilidad, afrontando las nuevas situaciones y apoyando, sin ninguna duda, a los trabajadores.&lt;br /&gt;Agradecer a todos/as la solidaridad y compromiso con los compañeros afectados y la preocupación por su bienestar, que nos han hecho llegar y que así mismo se lo hemos transmitido. Son admirables las muestras de auténtico compañerismo y amistad que han quedado manifiestas en este proceso por parte de todos aquellos, que han querido arrimar el hombro y estar ahí, junto a los trabajadores, de una manera u otra.&lt;br /&gt;Desde este sindicato damos las gracias a todos ellos/as y adquirimos aun si cabe un compromiso mucho mayor.
